Welcome to Williams Wellness Botanicals LLC (“Williams Wellness Botanicals,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, williamswellnessbotanicals.com (the “Site”), and any purchases of products or services made through the Site (collectively, the “Services”).

By accessing or using the Site, or by placing an order, you agree to be bound by these Terms and our other policies referenced here, including our Privacy Policy, Refund Policy, Shipping Policy, and Purchase Options & Subscription Policy. If you do not agree to these Terms, please do not use the Site.

1. Use of the Website

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates any applicable law or regulation.

  • Attempt to gain unauthorized access to any portion or feature of the Site or our systems.

  • Interfere with or disrupt the operation of the Site or the servers or networks connected to the Site.

  • Use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission.

  • Use the Site to send spam, chain letters, junk mail, or any other unsolicited communications.

We reserve the right to suspend or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms or engaged in any improper use of the Site.

2. Eligibility

By using the Site, you represent and warrant that:

  • You are at least 18 years of age, and

  • You have the legal capacity to enter into a binding contract in your jurisdiction.

All detox products and supplements offered through the Site are intended only for individuals 18 years of age or older. By purchasing these products, you represent that you are at least 18 years old.

3. Accounts

You may create an account on the Site to manage orders and subscriptions. You are responsible for:

  • Maintaining the confidentiality of your login credentials, and

  • All activities that occur under your account.

You agree to notify us immediately of any unauthorized access or use of your account.

We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion, subject to applicable law.

4. Products, Orders & Handmade Freshness

Williams Wellness Botanicals is a family-owned business, and we handcraft our herbal teas and elixirs in-house.

Upon payment, your items shall be handmade upon order to help ensure freshness. Because our products are made fresh to order and are consumable items, order changes and cancellations are limited (see our Refund Policy for details).

We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address.

We reserve the right to:

  • Refuse any order you place with us;

  • Correct any errors or inaccuracies in product listings or pricing;

  • Modify or discontinue products at any time without prior notice.

If we cancel or change an order, we may attempt to notify you using the email and/or billing address/phone number provided at checkout.

5. Pricing, Payments & Billing

All prices listed on the Site are in U.S. dollars (USD) unless otherwise stated. Prices and availability are subject to change without notice.

We accept various payment methods as shown at checkout. By submitting payment information, you represent and warrant that:

  • You are authorized to use the chosen payment method; and

  • You authorize us (or our third-party payment processor) to charge the full amount of your order, including any applicable taxes and shipping.

If your payment method fails or your account is past due, we may:

  • Suspend or cancel any pending orders or subscriptions; and/or

  • Charge any other payment method associated with your account, where applicable.

Sales tax will be applied where required by law.

6. Shipping, Risk of Loss & Delivery

Shipping options, approximate delivery times, and costs are provided at checkout. For more details, please see our Shipping Policy.

Once an order has been given to the carrier, risk of loss passes to you. We are not responsible for delays, losses, or damages caused by the shipping carrier or circumstances beyond our control (e.g., weather, carrier delays, incorrect addresses provided at checkout).

If your order arrives damaged or incorrect, please contact us promptly so we can review the issue in line with our store policies.

7. Returns, Refunds & Order Changes

Because our products are consumable items and are handcrafted to order, we do not accept returns of any kind at this time. This is for the safety of our community and staff.

In general:

  • If your product has not yet shipped, you may be eligible for a refund within the time window and conditions described in our Refund Policy.

  • Once a product has shipped and is no longer in our possession, it is typically not eligible for cancellation, return, or refund, except as required by law or as described in our Refund Policy.

8. Subscriptions & Recurring Billing

We offer Subscribe & Save options on certain products. When you enroll in a subscription:

  • You agree to recurring charges at the frequency you select (e.g., monthly, biweekly) until you cancel.

  • Your payment method will be charged automatically at each renewal, at the then-current subscription price, plus applicable taxes and shipping.

You can manage, modify, or cancel your subscription through your customer account, subject to any cut-off times described in our Purchase Options & Subscription Policy.

It is your responsibility to ensure that your payment details and shipping address are kept up to date. Failure to update your information may result in failed charges or missed shipments.

9. Health & Wellness Disclaimers (No Medical Advice)

Our products and any statements on the Site have not been evaluated by the Food and Drug Administration (FDA). Our products are not intended to diagnose, treat, cure, or prevent any disease.

Information provided on the Site (including any blog posts, product descriptions, or educational content) is for general informational and educational purposes only and is not a substitute for:

  • Professional medical advice

  • Diagnosis

  • Treatment

You should always:

  • Consult your physician or qualified healthcare provider before using any herbal products, especially if you have a medical condition, are pregnant or breastfeeding, or are taking prescription medication.

10. Intellectual Property

The Site and all of its content, features, and functionality—including but not limited to text, graphics, logos, icons, images, product descriptions, videos, and the overall design and layout—are the property of Williams Wellness Botanicals LLC or its content suppliers and are protected by copyright, trademark, and other intellectual property laws.

Without our prior written permission, you may not:

  • Copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material on the Site, except for your personal, non-commercial use.

  • Use any trademarks, logos, or service marks displayed on the Site (whether registered or unregistered).

All rights not expressly granted in these Terms are reserved by Williams Wellness Botanicals LLC.

11. User Content & Reviews

If you submit any content to the Site, including reviews, comments, testimonials, or other materials (“User Content”), you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media.

By submitting User Content, you represent and warrant that:

  • You own or control all rights in and to the User Content; and

  • The User Content does not violate any rights of any third party, including privacy, publicity, or intellectual property rights; and

  • The User Content is not unlawful, abusive, defamatory, obscene, harassing, or otherwise objectionable.

We may, but are not obligated to, monitor, edit, or remove User Content at our sole discretion.

12. Third-Party Links & Tools

The Site may contain links to third-party websites or services that are not owned or controlled by us. These links are provided for your convenience only.

We do not:

  • Endorse or assume responsibility for any third-party sites or resources; or

  • Control the content, policies, or practices of such sites.

Your use of third-party sites is at your own risk and subject to their terms and policies.

We may also provide access to third-party tools “as is” and “as available” without any warranties. Your use of such tools is entirely at your own discretion and risk.

13. Limitation of Liability

To the fullest extent permitted by law, in no event shall Williams Wellness Botanicals LLC, its owners, family members, employees, agents, or contractors be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages; or

  • Loss of profits, revenue, data, goodwill, or other intangible losses

arising out of or in connection with:

  • Your access to or use of (or inability to access or use) the Site or Services;

  • Any conduct or content of any third party on the Site;

  • Any products purchased through the Site; or

  • Unauthorized access, use, or alteration of your transmissions or content.

In no event shall our total aggregate liability to you for all claims arising out of or relating to the Site, Services, or these Terms exceed the greater of:

  1. The amount you paid to us for the product(s) giving rise to the claim during the three (3) months prior to the event giving rise to such claim, or

  2. One hundred U.S. dollars (USD $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless Williams Wellness Botanicals LLC, its owners, family members, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or related to:

  • Your violation of these Terms or any applicable law;

  • Your use of the Site or Services; or

  • Your violation of any third-party rights, including intellectual property or privacy rights.

15. Governing Law & Dispute Resolution

These Terms and any dispute arising out of or relating to them or your use of the Site or Services shall be governed by and construed in accordance with the laws of the State of Georgia, without giving effect to any conflict of law principles.

Any legal suit, action, or proceeding arising out of or related to these Terms or the Site shall be instituted exclusively in the state or federal courts located in Rockdale County, Georgia, and you consent to the personal jurisdiction and venue of such courts.

16. Changes to the Site and These Terms

We may update, modify, or discontinue any part of the Site or Services at any time without prior notice.

We may also revise these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Your continued use of the Site after any changes are posted constitutes your acceptance of the revised Terms.
